Terms and Conditions
Terms of sale and use for Paulownia Timber Supplies Australia, operated by Sine Surf Pty Ltd (ABN 24 655 648 374), Hornsby, NSW.
These terms apply to all quotes, orders and sales made through our website, by email, by phone or in person. Please read them before placing an order.
1. Nature of Our Products & Customer Responsibility
Working with Natural Timber: We supply premium Paulownia, but it is important to remember that wood is a natural, living material. Even a stable timber like Paulownia can experience slight movement, expansion, or changes in color over time. It is also susceptible to rot or mold if not properly sealed or maintained in wet environments.
Determining Suitability: It is entirely up to you (the purchaser) to decide if our timber is the right fit for your specific project. You must ensure that your use of the timber complies with any relevant building codes, fire safety regulations, or marine standards required for your build.
Liability for Finished Goods (Surfcraft & Marine): We supply raw materials (rough-sawn planks, dressed timber, and glued sheets). We take no responsibility for the structural integrity, buoyancy, or safety of any surfboard, handplane, boat, or other item you manufacture using our wood. The safety and performance of the final product rely completely on your design, shaping skills, and construction/fiberglassing methods.
2. Quality, Tolerances, and Grading
Rough-Sawn Timber: If you are purchasing rough-sawn stock, expect natural inconsistencies, rough edges, and machining marks. This material is sold with the expectation that you will be docking and dressing it yourself.
Dressed and Architectural Timber: For our milled products (like VJ lining boards), we grade by hand based on the primary face that will be visible once installed. We do not grade the back faces, tongues, or grooves.
Movement Tolerances: While we kiln-dry our timber to minimize movement, minor bowing or cupping can occur during transport or storage. We consider standard industry tolerances acceptable.
Color and Grain Matching: Because every tree is different, we cannot guarantee that the timber you receive will perfectly match a previous order, a small sample, or the photos on our website.
3. Ordering Allowances
Wastage Planning: When ordering timber for shaping, milling, or cladding, it is your responsibility to calculate the correct amount. We highly recommend adding an allowance to your order to account for waste, docking of ends, and natural anomalies in the wood.
4. Supply and Delays
Estimated Lead Times: Any delivery dates or lead times we provide are good-faith estimates. To the extent permitted by law, we cannot be held financially responsible for any delays in supplying your order, nor are we liable for any resulting costs you might face, such as delayed project timelines, lost wages for contractors, or manufacturing downtime.
5. Commercial and Trade Relationships
Direct Customers Only: Our business relationship and any associated product guarantees exist solely with the person or company who directly purchases from us.
Third-Party Claims: If you are a builder, shaper, or contractor using our timber for a client, you are responsible for managing that relationship. We will not engage in disputes, claims, or liability discussions with your end-clients, homeowners, or retail customers regarding the performance or suitability of the wood used in your project.
6. Quotes, Prices and Payment
All prices are in Australian dollars and include GST unless stated otherwise.
Quotes are valid for 30 days unless we tell you otherwise, and are subject to stock availability.
Orders are confirmed once payment is received. Custom and made-to-order work may require payment in full before we begin.
We may correct obvious pricing or typographical errors on our website or in quotes before an order is confirmed.
7. Delivery, Pickup and Risk
Items 1 metre or less are generally sent by Australia Post. Longer items are quoted for freight individually. See our shipping and delivery page.
Risk in the goods passes to you when they are collected by you or delivered to the address you provide. Ownership passes to you once we have received full payment.
Please inspect your order on arrival and tell us about any transit damage or incorrect items within 7 days.
8. Your Rights under the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded or limited. See our returns and refund policy.
9. Limitation of Liability
To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law, our liability for any loss or damage in connection with goods we supply is limited, at our option, to replacing the goods, supplying equivalent goods, or refunding the price paid. We are not liable for indirect or consequential loss, including loss of profit, labour costs or project delays, except where such liability cannot be excluded by law.
10. Website Use and Intellectual Property
The content on this website, including text, photographs and logos, belongs to us or our licensors and may not be copied or reused without our permission. Product photos are representative only, as natural timber varies.
11. Privacy
We handle your personal information in accordance with our privacy policy.
12. Governing Law and Changes
These terms are governed by the laws of New South Wales, Australia. We may update these terms from time to time; the version published on this page at the time of your order applies.
13. Acceptance of Terms
By placing an order with Paulownia Timber Supplies Australia (Sine Surf Pty Ltd), whether online, via email, or in person, you agree to these Terms of Sale and Use in their entirety.
